Renewable Energy Directive

AmendedDirective

Introduction

Directive (EU) 2018/2001, commonly known as RED II (Renewable Energy Directive II) and subsequently amended by Directive (EU) 2023/2413 (RED III), is the legal framework for the development of renewable energy across all sectors of the EU economy. As a recast of the previous 2009 directive, it establishes a common system to promote energy from renewable sources, crucial for the EU's goal of reaching climate neutrality by 2050.

Main Goal

The primary objective is to substantially increase the share of renewable energy in the EU's gross final energy consumption. The Directive sets a binding Union target and establishes specific sub-targets for sectors such as transport, heating and cooling, buildings, and industry to ensure the EU meets its climate obligations.

Who It Applies To

This Directive applies to:

  • Member States: Required to transpose rules into national law and meet national contributions.
  • Energy Producers: Operators of wind, solar, biomass, geothermal, and other renewable installations.
  • Fuel Suppliers: Entities supplying fuel to the transport sector (obligated to supply renewable fuels).
  • Industrial Actors: Manufacturers using energy or hydrogen in production processes.
  • Bioenergy Sector: Producers of biofuels, bioliquids, and biomass fuels (must meet sustainability criteria).
  • District Heating/Cooling Operators.

Key Provisions

  • Overall Target: Sets a binding Union target of at least 42.5% (aiming for 45%) renewable energy share by 2030.
  • Permitting Acceleration: Mandates faster administrative procedures for renewable projects, introducing "renewables acceleration areas" with shorter deadlines (e.g., 12 months).
  • Sectoral Targets:
    • Industry: Indicative annual increase of renewable energy use of 1.6%.
    • Buildings: Indicative target of 49% renewable energy share by 2030.
    • Transport: Binding targets to reduce greenhouse gas intensity (14.5%) or achieve a renewable share (29%) by 2030.
  • Sustainability Criteria: Strict greenhouse gas (GHG) saving and land-use criteria for biofuels, bioliquids, and biomass fuels to ensure they are actually sustainable (addressing ILUC - indirect land-use change).
  • Guarantees of Origin (GOs): Rules for issuing and trading GOs to prove the renewable origin of energy.
  • RFNBOs: Specific targets for Renewable Fuels of Non-Biological Origin (e.g., renewable hydrogen).

Obligations & Requirements

  • For Fuel Suppliers: Must ensure a minimum share of advanced biofuels and renewable fuels of non-biological origin (RFNBOs) in the transport sector.
  • For Bioenergy Operators: Must undergo independent audits to verify compliance with sustainability criteria (protection of high-carbon stock land, biodiversity, soil quality) to count towards targets or receive subsidies.
  • For Industry: Requirements to incorporate renewable hydrogen (42% of hydrogen use by 2030).
  • For Member States: Obligation to map renewable potential and designate acceleration areas.

Exemptions

  • Small Installations: Certain sustainability criteria for biomass apply only to installations above specific thermal input thresholds (e.g., ≥ 7.5 MW for solid biomass, though states can lower this).
  • Specific Geographies: Derogations available for outermost regions and small islands regarding certain support schemes.

Penalties

Penalties are determined at the National level by Member States but must be effective, proportionate, and dissuasive. Non-compliance by economic operators usually results in:

  • Loss of financial support/subsidies.
  • Inability to count fuel towards renewable energy quotas (rendering the fuel commercially valueless for compliance markets).
  • Administrative fines defined by national legislation.

  • Bioenergy Producers: Immediate compliance required with sustainability criteria (as transposed) to count towards targets/subsidies. Criteria tightened for installations starting after Jan 2021.
  • Industry: By 2030, 42% of hydrogen used for final energy and non-energy purposes must be RFNBOs (Renewable Fuels of Non-Biological Origin).
  • Transport Suppliers: By 2030, must achieve either a 14.5% GHG intensity reduction or 29% renewable share.
