Road Transport Social Legislation Harmonisation Regulation

AmendedRegulation

Introduction

Regulation (EC) No 561/2006 is the primary European Union legislation establishing rules on driving times, breaks, and rest periods for professional drivers in the road transport sector. Enacted to harmonize conditions of competition between modes of inland transport and to improve working conditions and road safety, it replaced Council Regulation (EEC) No 3820/85. The regulation is a cornerstone of EU social legislation for the transport industry, directly linking operational logistics with workforce welfare.

Evolution and Relations

This regulation functions in tandem with Regulation (EU) No 165/2014 (on tachographs), which provides the technical means for monitoring compliance. It has been significantly amended by the Mobility Package I (Regulation (EU) 2020/1054) to address modern logistics challenges, including the rise of light commercial vehicles in international transport and the quality of driver rest conditions. Most recently, it was amended by Regulation (EU) 2024/1258 regarding occasional passenger services.

Main Goal

The regulation aims to:

  • Improve road safety by preventing driver fatigue.
  • Ensure adequate social protection and working conditions for drivers.
  • Harmonize competition across the EU internal market to prevent unfair advantages gained through non-compliance or poor labor standards.

Who It Applies To

The Regulation applies to the carriage by road of:

  • Goods: Where the maximum permissible mass of the vehicle (including trailer) exceeds 3.5 tonnes.
  • Passengers: By vehicles constructed or adapted to carry more than 9 persons (including the driver).
  • International Light Transport (Future): From 1 July 2026, it will apply to vehicles exceeding 2.5 tonnes engaged in international transport or cabotage.

It applies to transport undertaken exclusively within the EU or between the EU, Switzerland, and EEA countries.

Exemptions

Article 3 and 13 list specific exemptions where the regulation does not apply, including but not limited to:

  • Vehicles used by emergency, medical, or public order services.
  • Vehicles with a maximum speed not exceeding 40 km/h.
  • Non-commercial carriage of goods (personal use) in vehicles < 7.5 tonnes.
  • Specialized breakdown vehicles operating within a 100 km radius.
  • Vehicles undergoing road tests.

Key Provisions

Driving Time Limits

  • Daily Driving: Maximum 9 hours (can be extended to 10 hours twice a week).
  • Weekly Driving: Maximum 56 hours.
  • Bi-Weekly Driving: Total accumulated driving time over any two consecutive weeks must not exceed 90 hours.

Breaks

  • After 4.5 hours of driving, a driver must take an uninterrupted break of at least 45 minutes.
  • This can be split into a first break of at least 15 minutes followed by a second of at least 30 minutes.

Rest Periods

  • Daily Rest: Minimum 11 hours (regular). Can be reduced to 9 hours (max 3 times between weekly rests).
  • Weekly Rest: A regular weekly rest of 45 hours is required. A reduced weekly rest of 24 hours is permitted under specific compensation conditions.
  • Cabin Ban: Regular weekly rest periods (45h) cannot be taken in the vehicle; employers must provide suitable gender-friendly accommodation.
  • Return to Home: Transport undertakings must organize work so drivers can return to their operational center or place of residence every 4 weeks (or 3 weeks depending on the schedule).

Obligations & Requirements

  • Recording: Use of tachographs (analog or digital/smart) is mandatory to record driving and rest times.
  • Data Retention: Undertakings must download vehicle unit data at least every 90 days and driver card data every 28 days, retaining records for at least 12 months.
  • Liability: Transport undertakings are liable for infringements committed by their drivers. Consignors, freight forwarders, and tour operators must also ensure schedules allow for compliance.
  • Scheduling: Employers are forbidden from offering bonuses related to distance/speed that would endanger safety.

Penalties

Member States are responsible for establishing penalties which must be effective, proportionate, dissuasive, and non-discriminatory. Penalties may include:

  • Financial fines for the driver and the undertaking.
  • Immobilization of the vehicle until a rest period is taken.
  • Withdrawal, suspension, or restriction of the undertaking's license or driver's license.
  • Penalties can be imposed by a Member State for infringements detected on its territory, even if committed elsewhere.
